Amending the Pharmacists and Pharmacy Technicians Order 2007

On 21 December 2007 the Government published proposals for an Order to amend the Pharmacists and Pharmacy Technicians Order 2007 (P&PTO), so as to bring pharmacy technicians in Scotland into the regulatory arrangements (among other changes).  This publication marked the start of a 13-week period of public consultation.

* These Regulations update the Pharmacists and Pharmacy Technicians Order, among other legisation, in line with European Community Directive 2005/36/EC

The new Order, which takes the form of a section 60 Order and which entirely replaces the Pharmacy Act 1954, will enable the Royal Pharmaceutical Society of Great Britain (RPSGB) to provide a modern and open system for the improved protection of patients and the benefit of health professionals.

The main provisions of the Order are:

Amendment to pharmacy technician provisions to include Scotland

The new arrangements relate to England, Wales and Scotland for pharmacists, and England and Wales only for pharmacy technicians. However, Ministers have announced that an amending Order is planned for later in 2007 that will extend the arrangements to pharmacy technicians in Scotland [see above].  The bringing into force of provisions in the Pharmacists and Pharmacy Technicians Order that relate to pharmacy technicians will accordingly be delayed until this amending Order is made, so that pharmacy technician provisions across Great Britain can be brought in at the same time.

There are separate arrangements for the regulation of pharmacy in Northern Ireland.
